Questions relating to whether or not an individual has the capacity to make important decisions regarding their health, finances, property or sexual relationships can often be assisted by a thorough assessment of the psychological factors surrounding the issues.

When a person has impairment in their intellectual, memory or language abilities such as dementia, their capacity to make specific important decisions can be brought into question. This can be because of learning disabilities, acquired brain injury or neurological disease. If a person is judged to lack capacity, then the Court of Protection becomes involved in appointing another person to make those decisions on the person’s behalf.

The central issues regarding the capacity to make a decision are:

  • Does the person understand the nature of the decision?
  • Can he or she weigh up the risks and benefits of taking one course of action over an alternative?
  • Can the individual retain the information pertinent to the decision?
  • Is he or she able to communicate the decision either verbally or non-verbally?

All of these questions clearly relate to a person’s thinking processes and can helpfully be addressed by a psychological assessment.

Assessment Process

Assessments for these purposes would involve an analysis of relevant background documents (e.g. medical records; Speech and Language Therapy reports), interviews with people familiar with the client and a neuropsychological assessment and interview with the client. In some cases, the client’s difficulties may be of a nature whereby standardized neuropsychological testing is not appropriate. In these situations, we can use other forms of assessment such as gathering information about their functioning from others who are regularly involved with the client or through observation of their functional behaviours.
